Personal data of persons under the age of 16

We do not intend to process personal data of persons under the age of 16. However, we cannot verify whether a visitor to our websites and servers is over the age of 16. If you are convinced that we have collected personal data of a minor without the consent of a parent or guardian, you can contact us via info@vivajewellerystore.nl and we will delete this information. If data of persons under the age of 16 is collected by us, this will always be done with the consent of his/her parent or guardian.

We have concluded processor agreements and/or confidentiality agreements with sub-processors to ensure the security of your data. We only work with partners who can comply with the GDPR legislation.

Mailblue is part of Active Campaign and is located outside the European Economic Area (the countries within the European Union, Liechtenstein, Norway and Iceland). Your data may be processed in America and/or other countries where this company has their cloud storage and servers and/or backups.

With this partner we have taken appropriate measures which have been contractually agreed via a processor agreement / Data Processing Addendum or via a model agreement of the European Commission (click here) . The stricter GDPR (the AVG) is already in effect with them. In this way we ensure that your data is well protected.

Transfer to third parties

In principle, we do not share or sell your data with persons or organizations outside Vivajewellerystore, except with partners as described above. It is also possible that we are required to pass on your data based on a legal obligation.

The security of your data

Vivajewellerystore has taken appropriate technical and organizational security measures to protect your personal data against misuse, unlawful or unauthorized use and loss.

All parties who process your data for us (subprocessors) or can view it (such as employees or temporary workers) sign a processing agreement or confidentiality statement.

How long will your data be retained?

We use different retention periods for different data flows. Of course, you always have the right to request us to delete your data. See also the heading “Your rights”.

Personal data:
We delete your name, address, telephone number and email address 7 years after our last contact.

Email:
Emails older than 1 year will be deleted unless they are still relevant for the execution of an agreement or resolving a dispute.

Invoices and quotes:
Invoices and quotes will be deleted after the legal retention period of 7 years. Your data will remain in our billing system until then.

Newsletter:
You can remove your data from our newsletter system at any time.

Your rights
You have the right to view, correct and delete your personal data. In addition, you have the right to withdraw your consent for the data processing or to object to the processing of your personal data by Vivajewellerystore.

You also have the right to data portability. You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to info@vivajewellerystore.nl. To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request.

In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. If your request concerns a cookie, we ask you to send this as well. We will respond to your request as soon as possible, but no later than within four weeks. Vivajewellerystore would also like to point out that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority.

Reporting a data breach

If, despite all precautions, a data breach occurs, we will comply with the data breach reporting obligation and, if necessary, report this breach to the Dutch Data Protection Authority within 72 hours of discovery.

If you discover a data leak, we kindly request that you share this with us as soon as possible, but in any case within 24 hours after you have discovered the leak, by sending an email to info@vivajewellerystore.nl . We can then take immediate action.

Liability

This privacy statement only applies to the personal data that Vivajewellerystore processes for the purposes discussed in this agreement. Vivajewellerystore accepts no responsibility or liability for (the operation and/or content of) third-party websites or services.

Changes to this statement

The content of this privacy statement can be adjusted at any time by Vivajewellerystore to respond to new developments in legislation or regulations or changes within our company. You can subscribe to our newsletter where we will keep you informed of any changes. In any case, we recommend that you consult this privacy statement regularly to stay informed of our privacy policy.
